Questions people ask about labour & workplace certifications

Are the four Labour Codes actually in force in my state?

Central government notified all four Labour Codes as effective from 21 November 2025 with Central Rules 2026 for all four. State-level implementation is on a rolling basis — states are notifying their State Rules and moving establishments from the superseded pre-Code regime (Factories Act 1948, Industrial Disputes Act 1947, EPF & MP Act 1952, etc.) to the new Code framework in sequence. Does the POSH Act 2013 apply to my organisation?

POSH applies to any workplace where ten or more workers are employed (Section 2(o) read with Section 4). "Workplace" is defined broadly — it covers offices, factories, hospitals, sports institutions, transportation used for the work, and any place visited by the employee arising out of or during the course of employment. Contract workers, apprentices and interns are included in the ten-count. If you employ ten or more workers in any capacity, you are required to constitute an Internal Committee under Section 4 and comply with the inquiry procedure under Section 11.

Do POSH and Labour Codes overlap for HR practitioners?

Yes, significantly. Most HR teams that run POSH compliance also run Labour Codes compliance for the same workforce. Both require formal committees, both have annual return obligations, both interact with the Companies Act Section 134 Board's Report disclosures for listed entities, and both are inspected together in most state labour-department audits. Working practitioners typically take the two certifications together as one integrated workforce-compliance stack.
